1 Acceptance of Terms
By downloading, installing, or using any 13 Halos mobile application or visiting 13halos.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms apply to all users of our apps and services, including free-tier users, Pro upgrade holders, and partner programme members.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
2 Eligibility
You must be at least 13 years of age to use our apps and services. By using the Service, you represent that you meet this age requirement.
If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have reviewed and agreed to these Terms on your behalf.
3 Licence to Use
Subject to these Terms, 13 Halos grants you a limited, non-exclusive, non-transferable, revocable licence to download and use our applications on your personal device(s) for your own personal, non-commercial use.
This licence does not include:
- Modifying, reverse engineering, decompiling, or disassembling any of our apps.
- Selling, licensing, sublicensing, or redistributing any app or portion of it.
- Removing or altering any proprietary notices, labels, or branding.
- Using our apps in any way that violates applicable law.
4 Pro Upgrades & Payments
4.1 Free Tier
Our apps offer a free tier with access to core features. The free tier may include advertising via Google AdMob. Some features are subject to daily or session-based usage limits as described in each app.
4.2 Pro Upgrade
Paid Pro upgrades unlock additional features, remove ads, and increase or remove usage limits. Pro upgrade pricing is announced per app at launch and displayed in the app and on our website. Upgrades may be available as one-time or recurring purchases depending on the app.
4.3 Billing
All Pro upgrade payments are processed by PayPal. We do not handle payment card data directly. PayPal's terms and privacy policy govern the payment transaction.
4.4 Cancellations & Refunds
Refund requests for Pro upgrades are subject to PayPal's policies. We do not offer direct refunds outside of what PayPal's dispute resolution process allows. Where a refund is granted, Pro access will be revoked upon completion.
4.5 Price Changes
We reserve the right to change Pro upgrade prices at any time. We will provide reasonable notice of price changes. Continued use after a price change takes effect constitutes acceptance of the new price.
5 In-App Rewards
Some of our apps may include a virtual reward system. Virtual rewards can be earned through in-app actions (such as watching rewarded ads, rating the app, or sharing the app) and may be used to unlock discount milestones toward Pro upgrades.
- Virtual rewards have no monetary value and cannot be exchanged for cash.
- Reward balances may be capped as described in each app.
- We reserve the right to modify, suspend, or discontinue any in-app reward system at any time.
- Rewards are non-transferable and will be lost if you uninstall the app or clear app data.
6 Partner & Affiliate Programme
6.1 Programme Overview
13 Halos operates an affiliate partner programme. Approved partners earn commissions for referring users who purchase Pro upgrades for any 13 Halos app. Partners choose which app(s) they wish to promote when applying. Commission tiers are as follows:
6.2 Commission Calculation
All commissions are calculated on net revenue — that is, the upgrade price after deduction of applicable PayPal fees. Commission is not calculated on gross revenue.
6.3 Partner Eligibility & Approval
Participation in the partner programme is subject to approval by 13 Halos. We reserve the right to accept or reject any partner application at our sole discretion. Partners must comply with applicable advertising laws and regulations in their jurisdiction, including clear disclosure of affiliate relationships.
6.4 Partner Conduct
Partners may not engage in spam, misleading advertising, cookie stuffing, or any other fraudulent activity. Violation of these rules will result in immediate removal from the programme and forfeiture of unpaid commissions.
6.5 Programme Changes
13 Halos reserves the right to modify commission rates, programme terms, or discontinue the partner programme at any time with reasonable notice. Launch Partner rates are available for a limited time only and are subject to availability at 13 Halos's sole discretion.
7 Acceptable Use
You agree not to use our apps and services to:
- Store, distribute, or conceal illegal content of any kind, including but not limited to child sexual abuse material (CSAM). Such use is strictly prohibited and a violation of these Terms.
- Circumvent, disable, or interfere with any security or access control features of our apps.
- Attempt to gain unauthorised access to any portion of our apps or their related systems.
- Use our apps in any way that violates applicable local, national, or international laws or regulations.
- Impersonate any person or entity or misrepresent your affiliation with 13 Halos.
Important Notice
Encrypted and privacy features in our apps are designed for legitimate personal privacy — to protect lawful personal content from unauthorised access. Our apps operate entirely on-device and we have no access to your files, vault contents, or device data by design. This is what makes our apps trustworthy. However, using these features to store or conceal illegal content remains a violation of these Terms and the user's sole legal responsibility. Our apps are not tools for illegal activity.
8 Your Content
13 Halos does not claim ownership of any content you store, manage, or process using our apps. All photos, videos, audio, documents, notes, and other files remain your property.
Because content is stored locally on your device, we do not have access to your content and assume no responsibility for its backup, loss, or corruption. You are solely responsible for maintaining backups of your data.
9 Intellectual Property
13 Halos Group and its original content, features, functionality, and branding (including the 13 Halos name, logos, and individual app branding) are owned exclusively by 13 Halos Group and are protected by copyright, trademark, and other applicable intellectual property laws.
Nothing in these Terms transfers any intellectual property rights to you. You may not use our trademarks, logos, or branding in any way without our prior written consent, except as expressly permitted for approved affiliate partners.
10 Disclaimers & Limitation of Liability
10.1 Disclaimer of Warranties
Our apps and services are provided on an "as is" and "as available" basis. While we work to maintain a secure, reliable, and high-quality service, we cannot guarantee that any app will always be uninterrupted, error-free, or compatible with every device or operating environment.
To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We also do not guarantee the absolute accuracy or completeness of content generated through optional features such as OCR-scanned text or receipt recognition.
Our apps are distributed through official channels — 13halos.com and official app stores. We cannot guarantee the safety or integrity of any version of our apps obtained from unofficial or third-party sources, and we strongly advise against using any such copies.
10.2 Data Loss
Our apps operate entirely on-device. We strongly recommend maintaining your own backups of important data. We are not liable for any data loss resulting from device failure, accidental deletion, app uninstallation, or any other cause.
10.3 Limitation of Liability
To the maximum extent permitted by law, 13 Halos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim (or, if you are a free-tier user, zero).
11 Termination
We reserve the right to suspend or terminate your access to our apps and services (including revoking Pro access without refund) at our sole discretion if you violate these Terms.
You may stop using the Service at any time by uninstalling the application and cancelling any active Pro upgrades via PayPal.
Upon termination, all licences granted under these Terms will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will do so.
12 Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction in which 13 Halos Group operates.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
